TERMS AND CONDITIONS

Welcome to CCC! The service is provided by Canal de Comunicación Creativa, S.A. de C.V. (hereinafter referred to as the “Company”).

I. CONTRACTUAL RELATIONSHIP.

These terms and conditions (hereinafter referred to as the “Terms and Conditions”) regulate the use that the User makes of the Services, which are offered or will be offered through the website http://cccofamerica.com.mx hereinafter referred to as the “Portal”.
Derived from the foregoing, any person who wishes to make use of the Services offered on the Portal must read these Terms and Conditions carefully beforehand. The Company reserves the right to unilaterally modify, add or eliminate these Terms and Conditions at any time, in which case the Company will notify the User of said changes by means of a notice on the Portal. Likewise, the Company may modify the configuration of the Portal and / or the Services offered therein, without the need for prior notification to the User. The access or use of the Portal, as well as the use or access of the Services offered there, constitutes whoever does it, as a user of the Company (referred to as the “User (s)”). By accessing and using the Services and / or the Portal, the User agrees to be legally bound by these Terms and Conditions, which establish a contractual relationship between the User and the Company.
In this act, the User acknowledges that by clicking on the acceptance box, he / she will agree to the provisions of these Terms and Conditions, as well as its effects. The foregoing in accordance with the provisions of article 80 of the Commercial Code and 1803 of the Federal Civil Code. In case of not fully and completely accepting these Terms and Conditions, the User must refrain from clicking on the corresponding acceptance box. Notwithstanding the foregoing, the User acknowledges that the contracting of one or more of the Services may be subject to certain specific conditions that, depending on the case, replace, complete or modify these Terms and Conditions (hereinafter referred to as the “ Specific Agreements ”). Therefore, prior to accessing and using those Services, the User must review in detail the corresponding Specific Agreements that from time to time are made known to the User through the Portal.

II.SERVICES DESCRIPTION.

The Company, through the Portal, provides a subscription service that allows Users to access audiovisual content (hereinafter referred to as the “CCC Content”), transmitted through the Internet (referred to as the “Services”). The Portal, including the CCC Content, is property of the Company and is protected by the Laws of Copyright and Intellectual Property of Mexico and other countries.

III. MEMBERSHIP

In order to use the Services, the User must have access to the Internet, create a User account and provide a valid form of payment, which can be updated at any time (hereinafter referred to as the “Payment Form”). Your membership will be valid until you cancel it, which must be done before the monthly billing date, so that the cost of the following month is not charged.
The information indicated by the User to create their membership must be true. The User acknowledges that the trust placed in the creation of their membership or account will be at their own risk. Notwithstanding the foregoing, the Company will treat it confidentially.

IV. FREE TRIAL PERIOD.

In the event that you meet the eligibility criteria, which will be at the Society’s discretion, your CCC membership may start with a free trial period (whichever is in effect at the time). The Company may limit the trial period referred to in this section in order to avoid abuse. Likewise, the Company reserves the right to revoke said trial period and suspend the account if it considers that you are not eligible. In a non-limiting way, the following are some eligibility criteria: i) members in households that already have an account; ii) device identification; iii) email; iv) the name of the account holder; etc.
Once the free trial period referred to in the previous paragraph has concluded, and in the event that you have not canceled your account, the Company will charge your Payment Form the current amount corresponding to the plan to which it is promotion has been linked.

V. BILLING.

The costs for the Services and any other expenses incurred in relation to the use, such as taxes, will be charged monthly to the Payment Method. Said charge will be made on the calendar day corresponding to which you created your CCC account. In the event that your payment cannot be made satisfactorily, whatever the reason, access to the Services will be suspended until valid payment is obtained.
At any time, you can change your Payment Method, that is, your credit / debit card. It is important to mention that, in terms of the aforementioned, when you update your Payment Method, you authorize the Company to continue charging the costs for the Services and likewise, you will be responsible for the amounts not collected until that date. It is important to mention that, at no time, the Company will be responsible for the charges that the issuers of the Payment Method may charge it.
You may cancel your CCC membership at any time, notwithstanding the foregoing, in such event, you will have access to the Services until the last day of the billing cycle according to the contracted plan. It is important to mention that the Company will not grant the User refunds or credits. The procedure to cancel your CCC account is your cancellation, you must do it directly in the cancellation module within your profile.

IV. TAXES

In this act, each User and the Company acknowledge that they will be responsible for the payment of their respective taxes in accordance with the applicable legislation. Likewise, the Company will in no way be responsible for any obligation that Users must fulfill for their payment.

VII. REQUIREMENTS TO OBTAIN THE SERVICE.
Notwithstanding the provisions of these Terms and Conditions, the following must be observed: (i) To be a User of CCC Services, the person must have the legal capacity to be bound by these Terms and Conditions, having sufficient age of majority in the country where you contract the Services.
(ii) The CCC Contents are for strictly personal use, the User may not market them. For the consideration that you grant to the Company, you are granted a limited, non-exclusive and non-transferable license to access the CCC Services through our streaming service.
